RESOLUTION NO. 07-09-19

RESOLUTION REQUESTING SUBMISSION AND CALLING FOR AN ELECTION ON THE QUESTION OF A CHANGE IN USE OF THE LOCAL SALES AND SERVICES TAX IN THE CITY OF BEACON LOCATED WITHIN MAHASKA COUNTY.

            WHEREAS, the City of Beacon has previously imposed certain local option taxes, including a local sales and services tax, pursuant to Iowa Code Chapter 423B; and

            WHEREAS, the Iowa Code Section 423B.1(6)(a)(1)(c) provides that the question of the change in the use of revenues from a local sales and services tax already imposed shall be submitted to the registered voters of the city by the county commissioner of elections upon the request of the governing body of the city; and

            WHEREAS, the City Council of the City of Beacon finds it to be in the best interest of the City for the voters to be asked whether the use of revenues from the local sales and service tax shall be changed from the current use of 70% for municipal services contracted from another city and 30% for the City Hall fund to 100% for any lawful purpose.

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEACON, IOWA, as follows:

            1.         That the Board of Supervisors of Mahaska County, Iowa, is requested to cause to be submitted to the voters of Beacon, Iowa the question of the change in use of the local option sales and services tax already imposed to begin on January 1, 2020, and the following ballot proposition language for the proposed imposition of the local sales and services tax is approved:

            SHALL THE FOLLOWING PUBLIC MEASURE BE ADOPTED?     

                        _____ Yes 

                        _____ No

            Summary: To change the use of revenue from the local sales and services tax already imposed in the City of Beacon, Iowa, from the current use, which is:

            70%  for municipal services contracted from other cities

            30%  for the City Hall fund

To be used and allocated effective January 1, 2020, as follows:

            100% for the General fund and for any lawful purpose

            0% for property tax relief.

            2.         The Mahaska County Commissioner of Elections is hereby requested and authorized to place said ballot proposition language on the ballot for the general election to be held on November 5, 2019.

            3.         The City Clerk is hereby authorized and directed to promptly provide a certified copy of this resolution to the Mahaska County Commissioner of Elections and to notify the Mahaska County Board of Supervisors of the adoption of this resolution.
