09-07-11 – Alley Vacation – Lots 65 and 76

RESOLUTION NO. 09-07-11

RESOLUTION SETTING DATE FOR PUBLIC HEARING TO CONSIDER ORDINANCE TO VACATE THE NOTRH-SOUTH PUBLIC ALLEY, 20 FEET, BY 150 FEET, AND ADJOINING LOT 65 OF EVAN’S 1ST ADDITION AND LOT 76 OF PRICE’S ADDITION IN THE CITY OF BEACON, MAHASKA COUNTY, IOWA.

WHEREAS, a request has been made and the City wishes to consider the vacation and sale of the north-south public alley, and adjoining Lots 65 of Evan’s Addition and Lot 76 of Price’s Addition, in the City of Beacon, Mahaska County, Iowa, and is legally described as follows:

                                Commencing at the Northwest corner of Lot 76 of Price’s Addition to

 the Town of Beacon, Iowa, thence Southwesterly 10 feet to the center

of the 20 foot vacated alley lying between Lot 76 and Lot 65 of Evan’s 1st

Addition to the Town of Beacon, Iowa, thence Southeasterly 150 feet parallel

to the Westerly line of said Lot 76, thence Northeasterly 10 feet to the

Southwest corner of said Lot 76, thence Northwesterly along the Westerly

line of said Lot 76 to the point of beginning.

 

WHEREAS, said request has been reviewed by the Beacon City Council and recommended for approval subject to the city retaining utility easement rights down the alley.

WHEREAS, statute requires a public hearing on such vacations.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Beacon, Iowa that a public hearing shall be conducted on October 4, 2011 at 7:00 p.m. City Hall, Beacon, Iowa at which time persons may appear and speak for or against the vacation as legally described above.
