RESOLUTION NO. 09-08-11
RESOLUTION APPROVING THE DEED AND AUTHORIZING THE SALE OF THE NORTH-SOUTH PUBLIC ALLEY, 20 FEET BY 150 FEET, AND ADJOINING LOT 65 OF EVAN’S 1ST ADDITION AND LOT 76 OF PRICE’S ADDITION IN THE CITY OF BEACON, MAHASKA COUNTY, IOWA.
WHEREAS, the City of Beacon has deemed it advisable to consider the vacation and sale of the north-south public alley, 20 feet by 150 feet, and adjoining Lot 65 of Evan’s 1st Addition and Lot 76 of Price’s Addition in the City of Beacon, Mahaska County, Iowa.
WHEREAS, the Beacon City Council has vacated the public alley described above to the retention of utility easement rights down the alley and has held a public hearing on the proposed sale of the above-described alley, to the property owner, which owns the properties adjoining the alley.
NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Beacon, Iowa that Shawn C. Maxwell, Mayor, be and he is hereby authorized and directed to execute a Quit Claim Deed on behalf of the City of Beacon, Iowa conveying the above described real property to the adjoining property owner, and the Mayor and City staff are further authorized to take necessary action to accomplish said conveyance.
BE IT FURTHER RESOLVED by the City Council of the City of Beacon, Iowa that the said Quit Claim Deed b and is hereby approved and the City Clerk is hereafter authorized and directed to deliver said deed after execution to the adjoining property owner at a price of $0.25 per square foot plus publication and application costs applicable thereto.
